These Terms and Conditions govern your use of the Taboo Education website and your engagement with Taboo Education's services. Taboo Education is operated by Samantha Waite (ABN 33 168 042 050) as a sole trader based in Perth, Western Australia, Australia.

By using this website or engaging our services, you agree to these terms. Please read them carefully.

1. Services

Taboo Education provides death literacy education, workshops, keynote presentations, professional development sessions, individual consultations, and related educational resources. Services are provided to individuals, organisations, schools, healthcare providers, community groups, and other bodies.

All services are educational in nature. Taboo Education does not provide medical, legal, psychological therapy, or financial advice. If you require professional advice in these areas, please consult an appropriately qualified professional.

2. Bookings

Bookings are confirmed upon receipt of a signed proposal or written confirmation and, where applicable, payment of a deposit. We reserve the right to decline any booking at our discretion.

By confirming a booking, you agree to provide accurate information about your organisation, group size, and requirements, and to cooperate in good faith with the preparation and delivery of the session.

3. Cancellations and rescheduling

The following cancellation conditions apply unless otherwise agreed in writing:

Where a booking requires interstate or regional travel, Taboo Education may need to prepay flights, accommodation, and other travel expenses in advance. In the event of cancellation, the client is responsible for the applicable cancellation fee as outlined above, plus any non-refundable travel costs already incurred by Taboo Education. Receipts or evidence of travel bookings will be provided upon request.

Taboo Education reserves the right to cancel or reschedule a session due to illness, emergency, or circumstances beyond our reasonable control, including but not limited to severe weather, flight cancellations, or transport disruptions. In such cases, a full refund will be provided or an alternative date offered within 14 days of the cancelled session.

4. Online store and digital products

All purchases through our online store are processed by Stripe. By making a purchase, you agree to Stripe's terms of service in addition to these terms. All prices are listed in Australian dollars (AUD) and are inclusive of any applicable GST.

Digital products (downloadable resources) are provided as-is and are non-refundable once downloaded. Download links are valid for 48 hours from the time of purchase. If you do not download your product within this period, you will need to repurchase. If you experience a technical issue with your download link, please contact us at admin@tabooeducation.com within 48 hours of purchase and we will do our best to assist.

Digital products are licensed for personal use only and may not be reproduced, shared, or used for commercial purposes without prior written permission from Taboo Education.

Physical products, if any, are subject to a separate refund policy communicated at the time of purchase.

5. Intellectual property

All content on the Taboo Education website, including text, images, videos, graphics, session materials, and resources, is the intellectual property of Samantha Waite trading as Taboo Education, unless otherwise stated.

You may not reproduce, distribute, modify, or commercially exploit any content from this website or from our sessions without prior written permission. Educational materials provided during a session are for the personal use of participants only.

6. Individual consultations

Individual consultations are provided by Samantha Waite as a PACFA-accredited psychotherapist and Certified Practising Counsellor. All individual consultations are educational in nature and do not constitute psychological therapy or a therapeutic relationship. They are designed to provide information, guidance, and education on death-related matters, not to diagnose, treat, or provide psychological intervention.

Consultations are subject to Sam's professional obligations under the PACFA Code of Ethics, including confidentiality and its legal limits. Sam reserves the right to refer a client to more appropriate support services where necessary.

Taboo Education reserves the right to terminate an online consultation immediately and without refund in the event of inappropriate, abusive, or disrespectful behaviour by the client. This includes but is not limited to harassment, threatening language, sexually inappropriate behaviour or language, or any conduct that makes continuation of the session unreasonable.

7. Limitation of liability

To the maximum extent permitted by Australian law, Taboo Education's liability for any loss or damage arising from the use of our services or website is limited to the amount paid for the specific service giving rise to the claim.

We are not liable for any indirect, incidental, or consequential loss or damage. Nothing in these terms excludes any rights you have under the Australian Consumer Law that cannot be excluded by agreement.

All content, sessions, and materials provided by Taboo Education are educational and informational in nature only. They do not constitute legal, medical, financial, psychological, or professional advice. It is the responsibility of each individual to conduct their own independent research and seek appropriate professional advice before making any decisions based on information received through Taboo Education's services. Taboo Education accepts no liability for decisions made by individuals as a result of attending a session, reading website content, or engaging with any Taboo Education materials.

8. Testimonials and feedback

By submitting feedback through our feedback form and selecting that we may use your feedback as a testimonial, you grant Taboo Education a non-exclusive, royalty-free licence to use your feedback for marketing and promotional purposes, subject to your stated preference regarding anonymity.

We will always use feedback respectfully and in the spirit in which it was given.

9. Website use

You agree to use this website only for lawful purposes. You must not use the website in any way that causes or may cause damage to the website or impairment of its availability, or in any way that is unlawful, fraudulent, or harmful.

Our website may contain links to third-party websites including our Medium blog, YouTube channel, and social media profiles. These links are provided for convenience only. We have no control over the content of those sites and accept no responsibility for them.

11. Governing law

These terms are governed by the laws of Western Australia, Australia. Any disputes arising from these terms or your use of our services will be subject to the exclusive jurisdiction of the courts of Western Australia.
